All sales of products and services offered by SUNFLOWER on the Site are subject to these terms and conditions. Please read them carefully.

Article 1. Purpose

These general terms and conditions of sale ("CGV") are entered into between SUNFLOWER and any individual acting as a consumer and wishing to purchase the solar kits offered for sale on the Site ("Products").

These CGV apply, without restriction or reservation, to all sales of solar kits and accessories offered by SUNFLOWER on the Site.

Since the Products are intended exclusively for consumers, SUNFLOWER reserves the right to refuse any order that appears to be of an economic or commercial nature, such as large orders of the same product or any abnormal order in line with applicable jurisprudence.

Article 2. Products

2.1 Product Features

The essential characteristics of the Products are described and presented on the Site with the greatest possible accuracy. The choice and purchase of a Product is your responsibility, and before placing your order, you should review each Product description to understand its key features.

2.2 Product Availability

Products are available while displayed on the Site, within stock and supply limitations. SUNFLOWER reserves the right to modify its range of Products at any time.

If a Product becomes unavailable after your order is placed, SUNFLOWER will inform you by email and, if possible, offer a similar replacement Product. If you decline the replacement or if SUNFLOWER cannot offer a similar Product, your order will be canceled, and the price refunded.

Article 3. Product Pricing and Shipping Costs

Product prices are indicated in euros, including all taxes, excluding shipping fees, which are calculated at checkout based on the shipping address and selected method.

SUNFLOWER reserves the right to adjust prices at any time but will apply the prices indicated at the time of your order.

Article 4. Ordering

When browsing the Site, you can select Products of your choice by choosing their type and quantity, then clicking "Add to Cart." You can review your cart contents at any time and adjust quantities, delete items, view VAT and delivery fees, and view the total amount including tax before proceeding to checkout.

Once satisfied with your cart contents, you can click "Proceed to Checkout." After completing personal and shipping information, selecting your payment method, and accepting these CGV, your order is confirmed by completing payment. An email confirmation will summarize your purchases.

Article 5. Payment

SUNFLOWER reminds you that finalizing your order implies an obligation to pay the indicated price, covering both product and shipping costs.

Payment can be made by credit card, PayPal, or using SUNFLOWER's partner's installment plan.

Article 6. Shipping

Please consult our shipping policy for full details. SUNFLOWER is not liable for any damages resulting from inaccurate or incomplete delivery details provided during order placement.

Article 7. Right of Withdrawal

Under French consumer law, you have a 14-day period from receipt of the ordered Product to exercise your legal right of withdrawal, without providing any reason.

To exercise your right of withdrawal, notify SUNFLOWER within the 14-day period via the form provided in Appendix 1 or by email at info@sunflower.solar. Return the Product within 14 days of notifying SUNFLOWER, using the original packaging and a recorded delivery.

Article 8. Returns

If you find a defect on a Product upon delivery, you must provide proof and allow SUNFLOWER to verify. Products must be returned in perfect condition with all accessories.

Returns may result in a replacement or refund.

Article 9. Warranties

Legal Warranty: Hidden Defects – Conformity Defects

Products benefit from a legal conformity warranty and a hidden defects warranty. Additionally, a 20-year warranty is offered on photovoltaic panels and micro-inverters, with 2 years for other electrical components.

Article 10. Recycling of Electrical and Electronic Equipment

SUNFLOWER commits to free take-back of old equipment under specific conditions. Contact SUNFLOWER for recycling options.

Article 11. Liability

SUNFLOWER cannot be held liable for damages arising from misuse of the Products or failure to follow instructions.

Article 12. Claims – Mediation

In case of claims, contact SUNFLOWER at the contact details provided. You may also access the EU Online Dispute Resolution platform at https://webgate.ec.europa.eu/odr/.

Article 13. Applicable Law – Jurisdiction

These CGV are governed by French law. In case of disputes, the French courts will have exclusive jurisdiction.

Article 14. Modification

SUNFLOWER reserves the right to modify these CGV at any time, with changes effective immediately upon posting.

Article 15. Transfer Rights

SUNFLOWER may assign its rights and obligations under these CGV to third parties.

Article 16. Miscellaneous

If any clause of these CGV is declared void, the remaining clauses remain in effect.

Appendix 2 – INFORMATION REGARDING WARRANTIES FOR CONSUMERS

In addition to any commercial warranty provided, SUNFLOWER, as the seller, is responsible to its consumer Clients for any lack of conformity of the goods with the contract under Articles L.217-3 et seq. of the French Consumer Code and for hidden defects under Articles 1641 et seq. of the French Civil Code.

Legal Conformity Warranty:

Article L.217-3 of the French Consumer Code:

"The seller delivers a good that conforms to the contract and the criteria set out in Article L.217-5. They are liable for any lack of conformity at the time of delivery, which appears within two years of delivery. The seller is also responsible, within the same period, for any lack of conformity resulting from the packaging, assembly instructions, or installation when this is part of the contract or carried out under the seller’s responsibility, or when incorrect installation performed by the consumer under the contract is due to deficiencies or errors in the installation instructions provided by the seller."

Article L.217-4 of the French Consumer Code:

"The good is in conformity with the contract if it meets, where applicable, the following criteria:

1° It corresponds to the description, type, quantity, and quality, particularly regarding functionality, compatibility, interoperability, or any other characteristic as per the contract;

2° It is suitable for any specific use sought by the consumer, made known to the seller no later than when concluding the contract, and accepted by the latter;

3° It is delivered with all accessories and installation instructions, to be provided according to the contract;

4° It is updated as per the contract."

Article L.217-8 of the French Consumer Code:

"In case of a lack of conformity, the consumer has the right to have the goods brought into conformity by repair or replacement or, failing that, a price reduction or termination of the contract, as provided in this section.

The consumer also has the right to suspend payment of all or part of the price until the seller has fulfilled their obligations under this chapter, in accordance with Articles 1219 and 1220 of the French Civil Code.

The provisions of this chapter are without prejudice to the award of damages."

Legal Warranty Against Hidden Defects:

Article 1641 of the French Civil Code:

"The seller is bound by the warranty for hidden defects in the item sold that render it unfit for its intended use, or that so diminish this use that the buyer would not have acquired it or would have given a lesser price for it if they had known."

Article 1648, paragraph 1 of the French Civil Code:

"An action resulting from redhibitory defects must be brought by the purchaser within two years of discovering the defect."
